Eligibility

To be eligible to lawfully enter into a contract with Equity Digital Solutions, a trading style of THFS Digital Ltd through this site under English law you must be aged over 18 years.

Language

The contract between you and Equity Digital Solutions, a trading style of THFS Digital Ltd will be concluded in English.

Placing an order

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these, then you should contact us before placing an order with us. These Terms and Conditions and your use of our web site are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights. This website and our Terms and Conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. 

Accordingly, any products, services or promotions not permitted under your local law are not offered to you. A contract between the customer and Equity Digital Solutions, a trading style of THFS Digital Ltd, for the sale of our services will only exist once an order has been accepted and processed. This does not affect the customer’s statutory rights. Prices and availability of services is subject to change without notice. 

You will be guided through the order purchase process in emails.  You will not conclude a transaction directly on this website.  Once you have placed your order, we will send you an email acknowledgement providing you with your order details and the value of your order along with an invoice to commence service provision. This is not an order acceptance form from Equity Digital Solutions, a trading style of THFS Digital Ltd.

Unless we have notified you that we cannot accept your order or you have cancelled your order in accordance with our cancellation procedure, our acceptance of your order and the completion of the contract between Equity Digital Solutions, a trading style of THFS Digital Ltd, and you will take place when we have delivered the services to you.  You cannot cancel an order for services that have been delivered in part or full.

We may not accept your order  we suspect fraudulent activity or a violation of our terms and conditions (including our Privacy Policy) or if we identify a service or pricing error, or if we are unable to complete the delivery of the ordered service.

If we are unable to complete your order following our order acknowledgement, we will contact you by telephone or email advising you of this.

Payment and taxes

We do not process transactions through this website.

Any prices given on this website should be presumed to exclude VAT unless otherwise stated.  The current rate of VAT is 20%. 

We only accept payment by electronic bank transfer.

Delivery of services

All dates quoted for delivery of services are estimated delivery dates only and we can accept no liability for any loss or damage (whether direct or indirect) incurred due to delayed delivery.

Title

The legal ownership of the services provided and their end result will remain with Equity Digital Solutions, a trading style of THFS Digital Ltd, until full payment has been received.  

Risk

Once delivery has been completed, all risk is your responsibility.

Your responsibilities

When using this site, you shall comply with our terms and conditions. You shall act always in accordance with the law, custom and in good faith.

 Any complaint made should include:

• Contact details of the Complainant (including postal and e-mail address).
• The subject of the complaint.
• Date of purchase and details of service purchased.

Complaints should be made immediately of the Complainant becoming aware of the grounds for a complaint.

How We Will Handle Complaints

As soon as a formal complaint has been received, we will aim to acknowledge receipt within 3 working days.

We will look to respond no later than 8 weeks from receipt of complaint following our investigation.

Please note that if the details of the complaint are not clear and concise and there is ambiguity about what the subject matter is, the Complainant will be asked to clarify certain points.

Disclaimer & Limitations of Liability

Equity Digital Solutions does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members agents directors or employees or for any fraudulent misrepresentation. 

To the fullest extent permitted by law and save as provided above, neither Equity Digital Solutions, nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Equity digital solutions or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the services or their use or resale by you.

The limitations of liability in these conditions shall apply equally for the benefit of Equity Digital Solutions and any other associated company of Equity Digital Solutions as if references to Equity Digital Solutions included references to each such associated company. 

While Equity Digital Solutions uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and Equity digital solutions will not be responsible for any errors or omissions or for the results arising from the use of such information.

Equity Digital Solutions may assign or transfer any of its rights or sub contract any of its obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with the specific permission in writing of Equity Digital Solutions. No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.
